1. Acceptance of Terms

By accessing or using dari.online (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

3. Description of Services

DaRi operates a platform that facilitates:

  • Resume submission and approval for Korean nurses seeking employment in USA
  • Job interview coordination with US hospitals
  • EB-3 visa application processing through a partner immigration law firm in USA
  • Application status notifications and updates

IMPORTANT: DaRi is a FACILITATION PLATFORM ONLY. We are NOT an immigration law firm, employment agency, or visa guarantor.

4. User Eligibility

To use this Platform, you must:

  • Be at least 18 years of age
  • Be a licensed registered nurse in Korea
  • Have the legal right to work in the United States (upon successful visa issuance)
  • Provide accurate and truthful information

5. NO GUARANTEE OF VISA APPROVAL

5.1 NO IMMIGRATION GUARANTEE

WE DO NOT GUARANTEE, WARRANT, OR PROMISE:

  • Approval of your EB-3 visa application
  • Timeline for visa processing or approval
  • Successful immigration to the United States
  • Any specific outcome in your immigration case

5.2 Final Decision Authority

The final decision on visa approval rests solely with:

  • United States Citizenship and Immigration Services (USCIS)
  • U.S. Department of State
  • U.S. Consular Officers

DaRi has NO AUTHORITY OR INFLUENCE over these governmental decisions.

5.3 Visa Denials and Delays

Your visa application may be denied or delayed for reasons including but not limited to:

  • Ineligibility under U.S. immigration law
  • Incomplete or inaccurate documentation
  • Changes in U.S. immigration policies or laws
  • Background check issues
  • Quota limitations
  • Administrative processing delays
  • Consular officer discretion

DaRi is NOT responsible for visa denials or delays for ANY reason.

6. NO EMPLOYMENT GUARANTEE

6.1 Hospital Decisions

We facilitate job interviews with Maryland hospitals, but:

  • Hospitals make independent hiring decisions
  • We do NOT guarantee job offers
  • We do NOT guarantee interview invitations
  • We do NOT control hospital hiring criteria or timelines

6.2 Job Offer Withdrawal

Even after a job offer is made, it may be:

  • Withdrawn by the hospital
  • Made conditional on additional requirements
  • Delayed or modified

DaRi is NOT liable for job offer withdrawals, modifications, or delays.

7. USER RESPONSIBILITIES

7.1 Accuracy of Information

YOU ARE SOLELY RESPONSIBLE FOR:

  • The accuracy and completeness of all information you provide
  • The authenticity of all documents you upload
  • Updating your information if circumstances change
  • Ensuring all licenses and certificates are valid and current

7.2 False Information

Providing false, misleading, or fraudulent information:

  • May result in immediate account termination
  • May result in visa denial
  • May constitute a criminal offense under U.S. and Singapore law
  • May result in permanent immigration consequences

DaRi is NOT responsible for consequences arising from your provision of inaccurate information.

7.3 Compliance with Laws

You are responsible for:

  • Complying with all U.S. immigration laws and regulations
  • Complying with Korean laws regarding overseas employment
  • Maintaining valid nursing licenses and certifications
  • Attending interviews and appointments as scheduled
  • Responding to requests from immigration authorities

7.4 Document Submission

You must:

  • Submit all required documents in a timely manner
  • Ensure documents meet USCIS specifications
  • Respond promptly to requests for additional documentation
  • Bear all costs associated with obtaining required documents

Failure to submit required documents may result in application delays or denials. DaRi is NOT responsible for such consequences.

8. FEES AND PAYMENTS

8.1 Service Fees

You agree to pay all applicable service fees as displayed on the Platform. Fees are subject to change with notice.

8.2 NO REFUND POLICY

ALL FEES ARE NON-REFUNDABLE, INCLUDING IN THE EVENT OF:

  • Visa denial
  • Job offer withdrawal
  • Application abandonment by user
  • Changes in user's circumstances
  • Changes in immigration law or policy
  • Processing delays

8.3 Additional Costs

You are responsible for all costs associated with the visa application process, including but not limited to:

  • Filing fees
  • Medical examination fees
  • Document translation and apostille fees
  • Travel expenses
  • Attorney fees (if separately retained)

9. DISCLAIMER OF WARRANTIES

9.1 "AS IS" Service

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 No Warranty of Success

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Successful visa approval
  • Successful job placement
  • Accuracy of timelines or projections
  • Uninterrupted or error-free service
  • Security of data transmission

10. LIMITATION OF LIABILITY

10.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY SINGAPORE LAW: DaRi's total liability for any claims arising from your use of the Platform shall not exceed the amount of fees you have paid to DaRi in the 12 months preceding the claim.

10.2 Exclusion of Damages

WE ARE NOT LIABLE FOR:

  • Visa denials or delays
  • Job offer withdrawals or delays
  • Lost opportunities or employment
  • Emotional distress or mental anguish
  • Consequential, indirect, incidental, special, or punitive damages
  • Loss of income, profits, or business opportunities
  • Immigration consequences or status changes
  • Decisions made by USCIS, consular officers, or hospitals

10.3 Third-Party Actions

DaRi is NOT responsible for:

  • Actions or decisions of the immigration law firm in USA
  • Actions or decisions of US hospitals
  • Actions or decisions of U.S. government agencies
  • Changes in U.S. immigration law or policy
  • Acts of God, war, pandemic, or other force majeure events

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DaRi, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your provision of false or misleading information
  • Any immigration consequences you experience
  • Disputes with hospitals or the immigration law firm

12. ACCOUNT TERMINATION

12.1 Our Right to Terminate

We reserve the right to suspend or terminate your account at any time for any reason, including:

  • Violation of these Terms
  • Provision of false information
  • Fraudulent activity
  • Non-payment of fees
  • Abusive behavior toward staff or partners

12.2 Effect of Termination

Upon termination:

  • You lose access to the Platform
  • Fees paid are non-refundable
  • We may retain your data as required by law
  • Outstanding obligations survive termination

13. INTELLECTUAL PROPERTY

All content, trademarks, logos, and intellectual property on the Platform are owned by DaRi or its licensors. You may not:

  • Copy, modify, or distribute Platform content
  • Use our trademarks without permission
  • Reverse engineer or attempt to access source code
  • Create derivative works

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

14.2 Jurisdiction

ANY DISPUTES ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM MUST BE RESOLVED IN THE COURTS OF SINGAPORE. You irrevocably submit to the exclusive jurisdiction of the Singapore courts.

14.3 Arbitration

Before filing any lawsuit, parties agree to attempt good-faith negotiations. If negotiations fail, disputes may be submitted to arbitration under the Singapore International Arbitration Centre (SIAC) rules.

14.4 Waiver of Class Actions

You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.

15. CHANGES TO TERMS

We may modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use after changes constitutes acceptance. Material changes will be communicated via email or prominent Platform notice.

16. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and DaRi regarding the Platform.

18. NO LEGAL ADVICE

DaRi does NOT provide legal advice or immigration counseling. You should consult with qualified immigration attorneys for legal advice specific to your situation.

19. FORCE MAJEURE

DaRi is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters
  • War or terrorism
  • Pandemic or epidemic
  • Government actions or restrictions
  • Changes in immigration law
  • Technical failures beyond our control

20. SURVIVAL

The following provisions survive termination of these Terms:

  • Payment obligations
  • Indemnification
  • Limitation of liability
  • Dispute resolution
  • Intellectual property rights

  • Visa approval is NOT guaranteed
  • Job placement is NOT guaranteed
  • All fees are non-refundable
  • You are responsible for the accuracy of your information
  • Disputes must be resolved in Singapore under Singapore law
